Welcome to Kiosk (“Service”), operated by Freezm LLC (“we,” “our,” “us,” or “Company”). By accessing or using our services at kiosk.ac or any associated websites, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use our Service.

These Terms constitute a legally binding agreement between you and Freezm LLC regarding your use of the Service. Please read these Terms carefully before using our Service.

Kiosk is a file sharing service that enables users to upload, store, and share digital content. 6. Termination

6.1 Account Termination by Us

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to:

  • Copyright infringement
  • Distribution of prohibited materials
  • Security violations
  • Fraudulent activities
  • Violation of these Terms
  • Extended periods of inactivity
  • As required by law or regulation

6.2 Account Termination by You

You may terminate your account at any time by following the instructions on our Service or contacting us at [email protected].

6.3 Effects of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your content and account information
  • We may retain certain information as required by law or for legitimate business purposes
  • Sections of these Terms that by their nature should survive termination shall survive termination

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by Freezm LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User Content

You retain ownership of any intellectual property rights that you hold in content that you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your content solely for the purposes of providing and improving the Service.

8. Disclaimers and Limitations of Liability

8.1 Service Availability

The Service is provided on an “as is” and “as available” basis. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service will be available at any particular time or location
  • The Service is free of viruses or other harmful components

8.2 Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claims relating to the Service shall not exceed the amount you paid us, if any, in the past twelve months
  • We are not liable for any loss or damage arising from your failure to comply with these Terms

9. Indemnification

You agree to indemnify, defend, and hold harmless Freezm LLC and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of your use of the Service or violation of these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Wyoming, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the federal or state courts located in Wyoming.

11. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

12. Entire Agreement

These Terms constitute the entire agreement between you and Freezm LLC regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements.

13. Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
